For Christs Sake, here we go again, Florida can you please get your shit together already?
Attorney Stuart Finkelstein, 65 was arrested today and released on $150,000 bail after an appearance in federal court in Fort Lauderdale, Florida.
Why you may be asking? Why don’t people trust politicians and lawyers?
Because…they are well known to lie, cover up the truth, concealing it from the peering eyes of juries, voters and the system as a whole.
Our good friend Stuart Finkelstein actually proves that point but also takes it a wee step further. Turns out that Stuart collected nearly $1 million in fees by filing over 300 unauthorized lawsuits alleging violations of laws protecting disabled Americans in New York and Florida.
By the way, Stuart has been known as a hack attorney since 2007 in New York at the least, he has been barred from practicing law in New York until 2016.
The lawsuit says that Stuart Finkelstein stole the identities of 2 individuals to file lawsuits in New York and Florida. The lawsuits claimed that the individuals were unable to access public establishments because they did not comply with the Americans with Disabilities Act.
Seems legit except for one small detail, the ummm named individuals had never actually tried to go into the establishments and Stuart did not represent them as an attorney.
U.S. Attorney Geoffrey S. Berman said that “Stuart Finkelstein engaged in a galling scheme that was as profitable as it was brazen from at least October 2013 through last May.”
The actual criminal complaint filed in Manhattan federal court said Stuart Finkelstein made false representations to various establishments before suing them in the Southern District of New York and the Southern District of Florida. It also said he obstructed official judicial proceedings and then settled the fake lawsuits to collect about $930,000 in attorney fees.
And, he has also been charged with mail fraud, aggravated identity theft obstruction of justice and making false declarations to a court.
Previous news articles from New York and Florida earlier in the year may have lead authorities to Stuart’s door, the articles alleged the scheme and pointed out that Stuart usually targeted small businesses.
Of course Stuart plead not guilty, I mean…let’s hope his has good counsel.
